Terms of Use — CAWAPP

1. Purpose and acceptance of the terms

These Terms of Use ("Terms") govern the use of the services published by CAWAPP ("we", "our", "CAWAPP"), namely:

  • the corporate website cawapp.com
  • the games portal games.cawapp.com
  • the mobile games published by CAWAPP, notably Forge & Fall, and all future games
  • the associated technical services, notably the unified Cawapp ID identity

By accessing these services, downloading a game or creating an account, you ("you", "the User") acknowledge that you have read these Terms and accept all of their provisions without reservation.

If you do not accept these terms, you must immediately stop using our services.

2. Definitions

  • Service(s): all services published by CAWAPP referred to in article 1
  • User: any natural person of legal age or emancipated using the Services
  • Account: personal account created by the User via the Cawapp ID system
  • User content: any content created or provided by the User (nickname, friend code, scores, etc.)
  • In-App Purchases: purchases made within a game via the official Apple App Store and Google Play stores

3. Description of the Services

CAWAPP publishes and distributes mobile games for iOS and Android platforms. The Services include:

  • Access to the games via download from the official stores
  • A system of individual progression and leaderboards (monthly Global, perpetual Friends)
  • A unified Cawapp ID identity system across all CAWAPP games, with 3 progressive levels:
    • Level N0 (anonymous): immediate use without account creation
    • Level N1 (nickname): addition of a nickname and a friend code (friend_code)
    • Level N2 (linked account): linking the identity to an email (magic link), an Apple account or a Google account, for multi-device recovery
  • Social features: adding friends by code, friends leaderboards
  • In-app purchases for certain optional features (notably Premium)

Access to the Services requires a compatible device (smartphone, tablet) and an internet connection for online features (leaderboards, account save, etc.). The game remains accessible offline for local features.

4. Account creation and management

4.1 Eligibility conditions

To create an account of level N2 or higher (linked to an email), the User must be:

  • At least 16 years old if residing in the European Union
  • At least 13 years old if residing in a jurisdiction where this threshold applies (notably the United States)
  • If a minor, have obtained the prior consent of their legal guardian

Use in anonymous mode (N0) or with nickname only (N1) is not subject to any age restriction.

4.2 Account creation

The User undertakes to provide accurate information when creating their account. The nickname and friend code must not:

  • Contain insulting, racist, sexual, or public-order-infringing terms
  • Impersonate a real person or a brand
  • Contain contact details (email, phone, URL)

CAWAPP reserves the right to request the modification of a nickname that does not comply with these rules, or even to suspend the account concerned.

4.3 Account security

The User is solely responsible for the confidentiality and security of their account. They undertake to:

  • Not share their access with a third party
  • Notify CAWAPP if they suspect unauthorized access
  • Keep their recovery email address up to date (N2+ account)

CAWAPP cannot be held liable for the consequences of unauthorized access resulting from the User's negligence.

4.4 Multi-device and synchronization

A User may access their Cawapp ID account from several devices. Data (scores, progression, purchases) is synchronized automatically between devices according to the technical rules specified in each game's technical documentation.

Account merging in case of prior use of distinct identities on multiple devices is handled automatically by the Cawapp ID system in accordance with the rules established by CAWAPP.

5. Acceptable use

5.1 Prohibited behavior

The User undertakes to use the Services in compliance with these Terms. The following are strictly prohibited:

  • The use of third-party software intended to modify the game's behavior (cheats, trainers, bots, game automation)
  • The deliberate alteration of the system clock or other technical settings in order to falsify scores or the chronology of actions
  • The exploitation of bugs or flaws in the game for personal gain or to harm other users
  • The creation of multiple accounts intended to circumvent restrictions, unduly influence leaderboards, or harass other users
  • The use of social features (adding friends, friend code) for harassment, spam, or abusive behavior
  • The resale of Cawapp ID accounts or progression
  • Any attempt to reverse-engineer the game, decompile it, or modify the source code
  • Any use contrary to the laws in force in the User's jurisdiction

5.2 Anti-fraud measures

CAWAPP implements technical mechanisms to detect abusive behavior, notably:

  • Server-side validation of game timestamps (anti-cheat)
  • Detection of statistical inconsistencies (aberrant scores)
  • Validation of game sessions via technical tokens
  • Monitoring of leaderboards to detect manipulation

5.3 Sanctions

In the event of a breach of the above rules, CAWAPP reserves the right, at its sole discretion and without notice, to apply one or more of the following sanctions:

  • Warning
  • Cancellation of fraudulent scores
  • Temporary account suspension
  • Permanent account suspension ("ban")
  • Definitive deletion of the account and all its data
  • In the event of proven fraud regarding an in-app purchase, reporting to the relevant app store and, where appropriate, legal action

No compensation will be due in the event of a sanction for abusive behavior, including for in-app purchases not yet consumed.

6. In-app purchases

6.1 General description

CAWAPP games may offer optional in-app purchases ("IAPs") allowing access to additional features without altering the competitive balance of the game (no "pay-to-win"). These purchases are strictly optional: all CAWAPP games remain fully playable without purchase.

6.2 Forge & Fall — Premium pack

The Premium pack for Forge & Fall (€2.99 or local equivalent) is:

  • A one-time, non-recurring purchase (no subscription)
  • Permanent: yours forever, no expiry
  • Restorable on a new device as long as you are signed in with the same Apple or Google account

It unlocks:

  • The absence of forced advertising
  • 3 free power-ups per game (bomb, gravity reversal, magnet)
  • The ability to pause and resume a game in progress (up to 7 days)
  • Apple Family Sharing (iOS only, subject to Apple Family Sharing terms)

6.3 General conditions of IAPs

  • IAPs are processed and billed exclusively by the Apple App Store or Google Play Store depending on the platform used. CAWAPP neither collects nor stores any banking data.
  • Displayed prices may vary depending on local currency, applicable taxes and the stores' pricing policies.
  • Purchases are linked to the Apple or Google account used at the time of purchase. They are not transferable to another store account.
  • The Cawapp ID system allows the Premium status to be retrieved on any device signed in with the same Apple or Google account.

6.4 Refunds

Refunds are governed by the policy of the store that processed the purchase:

CAWAPP issues no direct refund except in exceptional cases governed by applicable law. In any event, in accordance with Article L221-28 of the French Consumer Code, the User acknowledges that in-app purchases constitute digital content supplied on an intangible medium whose performance began with their express agreement, and that they waive their 14-day right of withdrawal.

7. Advertising

7.1 Display of advertising

CAWAPP games finance their development in part through the display of advertising to users who have not purchased the Premium pack. The formats used may include:

  • Interstitial ads: displayed between game sessions, at intervals configured to minimize friction
  • Rewarded ads: voluntary viewing in exchange for an in-game advantage (power-ups, revive, etc.)

7.2 Tracking regulation

Advertising tracking (use of your IDFA/AAID advertising identifier) is subject to your prior consent in accordance with Apple's App Tracking Transparency (ATT) framework on iOS and equivalent provisions on Android.

If you refuse tracking, the advertising shown remains present but becomes non-personalized.

7.3 Removing advertising

Purchasing the Premium pack permanently disables all forced advertising (interstitials). Rewarded ads remain available as an optional tool, but their use becomes strictly voluntary.

8. Intellectual property

8.1 CAWAPP's rights

All elements making up the Services (games, source code, graphics, designs, sounds, music, texts, logos, trademarks, etc.) are the exclusive property of CAWAPP, unless explicitly stated otherwise, and are protected by copyright, trademark law, and more generally by French and international intellectual property.

Any reproduction, representation, modification, publication or adaptation, in whole or in part, is prohibited without CAWAPP's prior written authorization.

Any unauthorized use constitutes an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

8.2 The User's rights

The User has a personal, non-exclusive, non-transferable right of use of the Services, limited to private use compliant with these Terms.

The User remains the owner of the content they create (nickname, game choices, etc.) but grants CAWAPP a non-exclusive, worldwide, free license to use this content as part of operating the Services (displaying the nickname in leaderboards, for example).

8.3 Screenshots, streaming, community content

The User is authorized to:

  • Take screenshots and videos of their game sessions for personal, non-commercial purposes
  • Share this content on social networks and streaming platforms
  • Mention CAWAPP games in their posts

Commercial use (YouTube/Twitch monetization, sponsored articles, etc.) remains tacitly authorized by CAWAPP provided that:

  • The content does not harm the image of CAWAPP or its games
  • No confusion is created between the content creator and CAWAPP itself
  • CAWAPP trademarks and logos are used in accordance with their guidelines (no modification, no misuse)

9. Suspension and termination

9.1 Termination by the User

The User may at any time:

  • Uninstall CAWAPP games from their device
  • Delete their Cawapp ID account by following the procedure provided in the app settings or by contacting [email protected]

Account deletion is permanent and results in the loss of all progression, scores, non-transferable purchases, and the anonymization of historical leaderboards.

9.2 Termination by CAWAPP

CAWAPP may suspend or terminate a User's account:

  • In the event of a breach of these Terms (see section 5)
  • In the event of fraudulent or abusive behavior
  • In the event of prolonged inactivity (see privacy policy, section 9)
  • At the request of the competent authorities
  • In the event of discontinuation of the relevant Services

9.3 Effects of termination

Termination, whether by the User or by CAWAPP, results in:

  • Loss of access to the account and all its content
  • The progressive deletion of personal data in accordance with the privacy policy
  • The inability to recover the progression and Premium purchases linked to that account (except restoration from the app store for IAPs)

10. Limitation of liability

To the extent permitted by applicable law:

  • CAWAPP strives to provide reliable and available Services but does not guarantee the absence of interruption, the absence of bugs, or absolute security against external attacks.
  • CAWAPP cannot be held liable for indirect damages (loss of data, loss of game time, loss of earnings, etc.) resulting from the use of the Services.
  • In the event of a proven dispute, CAWAPP's liability is limited to the amount of in-app purchases actually made by the User during the 12 months preceding the claim.

These limitations do not apply in the event of gross or intentional fault by CAWAPP, nor in cases where applicable law prohibits any limitation of liability (notably regarding defective products or bodily injury).

11. Changes to the Terms

CAWAPP reserves the right to modify these Terms at any time, notably in the event of:

  • Changes to applicable regulations
  • Changes to the Services (new games, new features, new IAPs, etc.)
  • Changes to technical partnerships

Any substantial change will be:

  • Notified on games.cawapp.com with the new effective date
  • Notified by email to Users holding an N2 or higher account, where applicable, at least 30 days before entry into force

Continued use of the Services after the new Terms take effect constitutes acceptance. If you disagree, the User may terminate their account before that date.

12. Applicable law and dispute resolution

12.1 Applicable law

These Terms are governed by French law, without prejudice to the mandatory provisions more favorable to the consumer in force in their country of residence.

12.2 Amicable resolution

In the event of a dispute, the User is invited to contact CAWAPP by email at [email protected] to seek an amicable solution. A response will be provided within a maximum of 30 days.

12.3 Mediation

In accordance with Articles L.611-1 et seq. of the French Consumer Code, the User may, after a prior attempt at amicable resolution, refer the matter to a consumer mediator.

12.4 Competent courts

Failing amicable or mediated resolution, any dispute relating to these Terms or the Services will be submitted to the competent French courts, without prejudice to the consumer-protection rules applicable at the User's domicile.

13. Miscellaneous provisions

13.1 Entire agreement

These Terms, supplemented by the Privacy Policy, constitute the entire agreement between the User and CAWAPP concerning the use of the Services.

13.2 Partial invalidity

If any provision of the Terms were declared null or inapplicable, that nullity would not affect the validity of the other provisions, which would remain fully in force.

13.3 No waiver

The fact that CAWAPP does not invoke a breach of an obligation under these Terms shall not be interpreted as a waiver of the right to invoke that obligation later.

13.4 Assignment

CAWAPP may assign all or part of its rights and obligations under these Terms to a third party, notably as part of a restructuring, merger, acquisition or transfer of business. The User will be informed.

Legal document governed by French law. In the event of a discrepancy in interpretation between language versions, the French version prevails.
